How Capeway collects, uses, stores and discloses personal information, and the rights you have over it under POPIA.

This Privacy Policy explains how Cape Way INT (“CapeWay”, “we”, “us” or “our”) collects, uses, stores and discloses personal information in connection with its website and student-support services.

Information We May Collect

Depending on the service requested, Cape Way may collect identification and contact information, nationality and country of residence, academic and application information, education preferences, accommodation requirements, travel and airport-transfer information, correspondence, documents supplied by the student, payment-related information where applicable, and technical website information such as IP address, browser and device information.

Students should only provide information reasonably necessary for the services requested. Cape Way does not request payment-card numbers, passwords or other credentials through ordinary website enquiries.

Purposes for Processing

We may process personal information to provide and improve our services; assess and respond to enquiries; assist with institution and accommodation referrals; arrange requested third-party services; communicate with students; comply with legal and regulatory obligations; prevent fraud or misuse; maintain records; resolve disputes; and protect our legitimate business interests.

Where required by POPIA, Cape Way will process personal information on an appropriate lawful basis and will seek consent where consent is the appropriate basis.

Sharing with Third Parties

Cape Way may share relevant information with educational institutions, accommodation providers, airport-transfer providers, attorneys or immigration professionals, technology/service providers, professional advisers and public authorities where reasonably necessary for the requested service, legal compliance or protection of rights.

Cape Way will aim to limit disclosures to information reasonably necessary for the relevant purpose. Where a third party receives information, that third party may have its own privacy obligations and policies.

Direct Marketing

Cape Way may communicate information about its services, partner institutions or related opportunities where permitted by law. Where POPIA requires consent for direct electronic marketing, Cape Way will obtain and manage such consent in accordance with applicable requirements. Recipients may request that direct marketing communications stop.

Cookies and Website Technologies

The website may use cookies or similar technologies to support functionality, security, analytics and user experience. Users may be able to control cookies through browser settings, although disabling certain cookies may affect website functionality.

Security

Cape Way will implement reasonable technical and organisational measures designed to protect personal information against loss, damage, unauthorised access, interference, modification, disclosure or destruction. No internet-based system can be guaranteed completely secure.

Retention

Cape Way will retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide services, maintain appropriate business records, resolve disputes, comply with legal obligations and protect legitimate interests, subject to applicable law.

Data Subject Rights

Subject to applicable law and any lawful limitations, data subjects may request access to personal information held about them, request correction or updating of inaccurate information, object to certain processing, request deletion where legally applicable, and exercise other rights available under POPIA.

Requests may be directed to Cape Way using the contact number stated in this Policy. Cape Way may require reasonable verification before processing a request.

Complaints

A data subject may raise a privacy concern with Cape Way first. Where a complaint cannot be resolved, the data subject may exercise any applicable right to lodge a complaint with the Information Regulator of South Africa.

Cross-Border Processing

Where services require information to be shared with recipients outside South Africa or where service providers process information internationally, Cape Way will take reasonable steps to comply with applicable POPIA requirements concerning cross-border transfers.

Changes to this Privacy Policy

Cape Way may update this Privacy Policy when its services, technology or legal requirements change. The current version published on the website will apply from its stated effective date.

This document is published in English and in Arabic. The Arabic version is provided for convenience; where the two differ, the English version governs.
